I. Basic Provisions
- The General Contractual Terms and Conditions of LIPNO CARD system (hereinafter referred to as „Terms and Conditions“) regulate the rights and duties of the Card Holder while drawing the services of Acceptance Point under the advantageous conditions stated in the Manual and Information Portal and moreover the mutual rights and duties of the Operator and Card Holder while manipulating with the Card and administrating LIPNO CARD system.
- The contractual relationship being the subject of these Terms and Conditions comes into being between the Operator and Card Holder in the moment of the Card takeover by the Card Holder in the Selling Point.
- The Operator is LIPENSKO s.r.o., CRN: 28136420, Tax RN: CZ28136420, with registered office: Lipno nad Vltavou 307, Zip Code 382 78, registered in the Trade Register of the Regional Court in České Budějovice in Part C, file 19521, which operates and administers the LIPNO CARD system.
- The Card Holder is a natural person to whom the Card was issued by the Operator directly or through the Selling Point and the data of whom are put down in the Card.
- For the purpose of this Contract the below mentioned concepts shall have the following meaning:
LIPNO CARD system is marketing system consisting in generating advantageous conditions for drawing the services of Acceptance Points for Card Holders;
Card is a discount mean with the unique number and bar code of the usual payment card size with which the right of the Card Holder is connected to draw the services of Acceptance Points with advantages described in the Manual and in the Information Portal;
Selling Point is the accommodation provider or another subject involved into the LIPNO CARD system stated in the Manual or in the Information Portal, which is authorised based on the contract with the Operator as representative of the Operator to offer and to issue the Card to accommodated guests or to other interested persons;
Acceptance Point is the subject involved into the LIPNO CARD system stated in the Manual or in the Information Portal, obliged based on the contract with the Operator to provide its services to the Card Holder with the advantages described in the Manual or in the Information Portal;
Manual is information brochure issued by the Operator containing the basic information about the territory in which the LIPNO CARD system is operated including the map of the territory with marking the main tourist targets, Acceptance and Selling Points, information about LIPNO CARD system, conditions and way of 53 drawing advantages of the Card Holder, services of individual Acceptance Points as well as the text of these Conditions;
Information Portal are special web pages of LIPNO CARD www.lipnocard.cz system administered by the Operator and containing similar data as Manual which are moreover updated continually.
II. Rights and Duties of Card Holder
- Every Card Holder who presents the Card while negotiating about providing a service in the Acceptance Point or during the payment for provided services to the Acceptance Point has the right to draw the service of the Acceptance Point under advantageous conditions stated in the Manual or Information Portal.

The Card Holder takes into account that the Card is not transferable and the rights connected with it appertain
exclusively to the Card Holder. The Card Holder is obliged to desist from any acting the purpose of which is evading the principle of the non-transferability of the Card such as copying the Card, changing the Card or doing other interventions into the Card integrity. -
The Card Holder is obliged to keep the Card in the way preventing its loss, damage, destruction or theft. Each loss,
function damage, destruction or theft of the Card shall be announced by the Card Holder to the Operator without undue delay. - The Card Holder is obliged to utilize the Card only for the purposes for which it is determined according to these Terms and Conditions.
- While drawing the services of the Acceptance Point the Holder is obliged, upon request of the Acceptance Point or of the Operator to prove his identity by submitting a valid official identity card as personal identity card, passport or another official document based on which it is possible to find out the identity, otherwise the drawing of service with advantage may be rejected by the Acceptance Point.
III. Legal relations during drawing services

Legal relationship during service providing and drawing comes into being exclusively between the Acceptance Point
and the Card Holder. The Operator does not accept any liability or guarantee for the quality or proper fulfilment of the
commitment of the Acceptance Point towards the Card Holder and also not for observing the conditions of advantageous providing the service based on the promise of the Acceptance Point stated in the Manual or in the Information Portal. - The Card Holder takes into account that in the time between the issue of the Manual and the moment of drawing the service of the Acceptance Point by the Card Holder, a change in the 54 list of the Acceptance Points or temporary interruption of providing their services or changes in conditions of providing advantages may take place. Topical information concerning the list of Acceptance Points as well as functionality of LIPNO CARD system is published by the Operator in the Information Portal.
- Adding a new Acceptance Point to the LIPNO CARD system or deleting an Acceptance Point from the LIPNO CARD system in the time after accepting the Card by the Card Holder has no influence on the paid Card price.
IV. Blocking the Card, issue of the Card duplicate or a new Card

The Operator is authorised to block the Card if
- a) The Card Holder commits the prohibited act described in the section 2.2,
- b) The Card Holder breaches the duty stated in the section 2.4 and causes in this way the damage to the Operator or third persons,
- c) The Operator finds out that the Card was lost, destroyed or stolen or its function impaired,
- d) during drawing the services the card will be submitted to the Acceptance Point by the person who rejects to prove its identity or the identity of whom does not correspond to the Card Holder identity or
- e) The time of effectiveness of the Card elapsed.
- Card blocking is a temporary or permanent elimination of the active functions of the Card within LIPNO CARD System. The holder of the blocked Card is obliged to return the Card without undue delay to the Operator, if this is not excluded in view of the reason of Card blocking.
- In case of blocking the Card pursuant section 4.1 lit. a), b) or d) the contractual relationship between the Operator and Card Holder regulated by these conditions is cancelled. The Card Holder has in case of such cancellation no right to return of the paid Card price or to other compensations.
- In case of blocking the Card pursuant the section 4.1 lit . c) the Operator shall issue to the Card Holder the Card duplicate upon request, if the Card Holder returns the original Card to the Operator or a new Card, if the Card Holder is not able to return the original Card to the Operator. The Card Holder is obliged to pay to the Operator for the issue of Card duplicate or a new Card the price according to the topical price-list published in the Information Portal, if not agreed otherwise.
V. Protection of personal data of Card Holder

By accepting these Conditions the Card Holder expresses his approval to processing his personal data by the Operator provided in connection with the application for Card issue 55 in accordance with the provision § 5 et seq. of the Act No. 101/2000 Coll. Of the Personal Data Protection as amended (hereinafter referred to as „Act“) under the following conditions:
- a) definition of personal data: first name, surname, place of domicile, citizenship, details of electronic contact for electronic post, number of phone contact;

b) purpose of processing: execution of rights and duties following from these Conditions, statistics of drawing services through the Card, evaluation of functioning of LIPNO CARD system and its improvement, evaluation of quality of services of Acceptance Points and its improvement, the feedback between individual
subjects of LIPNO CARD system; - c) means and way or processing personal data: automatically as well as manually in the electronic as well as printed form;
- d) period for which the approval is issued: 5 years from Card issue;
- e) subjects to which the personal data may be made available: Operator, Acceptance Points and Selling Points.

The Card Holder has the right of the access to his personal data, right to personal data protection as well as
other rights pursuant § 21 of the Act. The Card Holder has the right to withdraw the approval to the processing his personal data in the written form at any time. -
The Operator is authorised to use the details of the electronic contact of the Card Holder for distributing the business
announcements concerning the LIPNO CARD system by electronic mail. The Operator is obliged in case of sending
each individual report to enable to the Card Holder in a simple way, to withdraw the approval to such use of his
electronic contact free of charge or at the account of the Operator.
VI. Final Provisions
- The contractual relationship between the Operator and Card Holder regulated by these Conditions is terminated by the elapse of the Card validity term. The cards issued in the time between the April 1 and October 30 in the year are valid in the time from June 1 to October 30 of the given year. The card issued in the time between the November 1 of the given year and March 31 of the following year are valid in this period. After the elapse of the term of Card validity the Card will be blocked automatically.
- The law of the Czech Republic is applicable to the contractual relationships.
